These Terms and Conditions govern the use of the sabaki.dance platform, a community platform for Salsa, Bachata, and Kizomba enthusiasts. By using our services, you agree to these terms.

1. About sabaki.dance

sabaki.dance is a platform that offers the following services:

Event-Discovery: Discovery of Salsa, Bachata, and Kizomba events in your area
Community-Features: Connect with other dancers
Messaging: Direct communication between community members
Profiles: Personal profiles with dance preferences and location information
Event-Management: Create and manage your own dance events
Location-Services: Location-based search and recommendations

2. Authorization to Use

Minimum Age and Requirements:

You must be at least 16 years old
You must provide a valid email address
You may only use the platform for private, non-commercial purposes
You agree to provide truthful information

Important Notice:

The use of the platform is exclusively intended for people who are interested in Salsa, Bachata, and Kizomba dancing and behave respectfully in the community.

3. Usage Rights and Restrictions

✅ Allowed:

Creating a personal profile with real information
Participating in events and community activities
Respectful communication with other users
Creating and promoting your own dance events
Sharing event information and dance content

❌ Prohibited:

Commercial advertising without permission
Spam, harassment or inappropriate content
False identities or fake profiles
Automated bots or scraping tools
Distribution of illegal content or discrimination
Abuse of the messaging function for unwanted messages
Copyright violations in images or content

4. User-Generated Content

By uploading content (profile pictures, event information, messages) you confirm:

You own the rights to the uploaded content
The content does not violate laws or third-party rights
You grant sabaki.dance the right to display the content on the platform
You retain all ownership rights to your content

5. Privacy and Data Protection

The protection of your data is important to us. Detailed information can be found in our Privacy Policy.

Key Points:

Your location data is only used for event recommendations
Messages are private and not shared with third parties
You can delete your profile and all data at any time
We do not sell personal data to third parties

5.1 Ticketing Service

Contracting Party and Intermediary Role

Important: sabaki.dance acts exclusively as an intermediary in ticket sales. The purchase contract is made directly between you as the buyer and the respective organizer.

Organizer: Responsible for event execution, quality, and refunds
sabaki.dance: Only provides the technical platform for payment processing
Stripe: Handles secure payment processing and KYC verification

Ticket Conditions

No Right of Withdrawal: Tickets for dance events are excluded from the statutory right of withdrawal (§ 312g BGB), as they are leisure services at a specific time. Ticket purchases are therefore final.

Cancellations and Refunds: Any goodwill arrangements (returns, rebooking) are solely at the discretion of the respective organizer. Contact the organizer directly if you have problems.

Ticket Transfer: Tickets are transferable - you can pass your QR code to other people. Tickets are not registered by name.

Payment Processing

Payment processing is handled through Stripe, a certified payment service provider. sabaki.dance does not store payment data. The platform receives an intermediary fee, which is automatically withheld by Stripe before the organizer receives their payout.

Liability Disclaimer for Ticketing

Event Cancellations: We are not liable for cancelled or postponed events
Event Quality: We are not responsible for the quality of the event
Organizer Behavior: Issues with organizers must be resolved directly with them
Technical Problems: For QR code problems at the entrance, contact the organizer

Privacy in Ticketing

When purchasing tickets, your contact details (name, email) are transferred to the organizer, so they can maintain the participant list. You agree to this data transfer with the purchase. Further details can be found in our Privacy Policy.

6. Liability Disclaimer

Important Liability Disclaimer:

Event Information: We are not responsible for changes, cancellations, or incorrect event data
User Behavior: We are not liable for the behavior of other users or third-party content
Technical Availability: The service is provided "as is" without guarantee of uninterrupted availability
External Links: We assume no responsibility for external websites or services

Damages: Our liability is limited to intent and gross negligence. In cases of slight negligence, we are only liable for breach of essential contractual obligations.

7. Violations and Consequences

In case of violations of these terms and conditions, we may:

Issue warnings
Remove or hide content
Temporarily suspend account (1-30 days)
Permanently delete account in case of serious violations
Initiate legal action in case of illegal activities

8. Termination of Use

You can at any time:

Delete your account yourself
Stop using the platform
Have your data deleted (see Data Deletion)

We may:

Discontinue the service with 30 days advance notice
Block accounts for violations of these terms
Make technical changes with reasonable advance notice

9. Changes to Terms and Conditions

We may change these terms and conditions as needed. Material changes will be announced at least 30 days in advance by email.

10. Choice of Law and Jurisdiction

Applicable Law: German law applies
Jurisdiction: The place of business of the provider has jurisdiction for disputes
EU Law: Consumer rights under EU law remain unaffected
Dispute Resolution: We do not participate in consumer dispute resolution proceedings
